Chapter 13 Bankruptcy: Debt Repayment Plan
In Chapter 13, also called a reorganization or a wage earner's plan, you will repay part of your debts over three to five years. The monthly payment is not based on what you owe, but what you can realistically afford. At the end of your plan, any remaining debts are wiped clean.
Chapter 13 is an option if you are not a candidate for Chapter 7 discharge of debts. For example, you may have to file for Chapter 13:
- If your income is too high under the bankruptcy means test
- If you have previously filed a Chapter 7 bankruptcy
- If you have mortgage arrears and looming foreclosure
- If you have non-exempt assets that would be forfeited in a Chapter 7
- To strip a second mortgage/home equity loan
Relief From Foreclosure and Creditors
On the date that your Chapter 13 bankruptcy is filed, creditors must stop all efforts to collect debt or collateral. This includes credit card companies and collection agencies. It stops wage garnishment and judgments. It stops home foreclosure and vehicle repossession.
