What Debts Can I Eliminate in Bankruptcy?

In a Chapter 7 bankruptcy, most unsecured debts can be eliminated with the help of a trusted attorney. Unsecured means not secured by collateral:

  • Credit card debt, charge accounts and cash advances

  • Medical bills not covered by insurance

  • Certain judgments

  • Certain back taxes

Once a debt is discharged in U.S. Bankruptcy Court through Chapter 7, you will not have to repay those creditors and they cannot come after you. In a Chapter 13, you are protected from creditors as long as you make the payments to the trustee, and any remaining debt is forgiven at the end of your plan.

What Debts Cannot Be Discharged?

  • Secured debt (mortgage and car payments if you are keeping your home or cars)

  • Recent income taxes (last three years)

  • Student loans

  • Child support or spousal maintenance

  • Criminal fines or restitution
